 Terms of Service for Jimly

Welcome to Jimly! These Terms of Service (“Terms”) govern your use of our application and services. By accessing or using Jimly, you agree to comply with and be bound by these Terms. If you do not agree, please do not use our services.

1. Acceptance of Terms

By creating an account or using Jimly, you affirm that you are at least 13 years old and have the legal capacity to enter into these Terms. If you are using Jimly on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Account Registration

2.1 To access the Service through the App, you must have an internet connection and download the App from a third-party marketplace, such as the App Store or Google Play. Each marketplace has its own rules and regulations, as well as minimum device or software requirements that we encourage you to review before downloading.

2.2 To be registered as a User, you must meet the following criteria:

- You are an individual (not a corporation, partnership, or other business entity) who is at least 18 years old.

- You are legally able to enter into a binding contract with the Company.

- You are not in a country under U.S. Government embargo or identified as "terrorist-supporting."

- You are not on any U.S. Government lists of prohibited individuals (such as the U.S. Treasury Department’s Specially Designated Nationals list) and do not face any similar prohibitions.

- You are not legally barred from using our Services.

- You have not been convicted of, or pled no contest to, any felony, sex crime, or violent offense, unless you have been granted clemency for a non-violent crime and we have determined you do not pose a threat to other users.

- You are not required to register as a sex offender on any registry at the state, federal, or local level.

- You have not been previously removed from our Services or those of our affiliates without our express written permission to create a new account.

2.3 To access the Service through the Site, you should have a device that allows internet access, an up-to-date web browser installed, and an internet connection.

2.4 The information you must provide to be registered as a User on the Site or App includes:

- Your name

- Your email

2.5 You agree that you are solely responsible (to us and to others) for the activity that occurs under your account.

2.6 You agree to:

- Provide accurate, current, and complete information as prompted by the registration forms via the App or Site (“Registration Data”).

- Maintain the security of your account password.

- Maintain and promptly update the Registration Data and any other information you provide to the Company, ensuring it remains accurate, current, and complete.

- Accept all risks of unauthorized access to the Registration Data and any other information you provide to the Company.

2.7 You agree that:

- As a natural person, you are of sufficient age (at least 13 years old) and capacity under the applicable laws of your jurisdiction to register and use the App or Site and the Service.

- You shall use the Services, the App, or Site only in accordance with applicable laws, these Terms, and in a legally and morally acceptable manner.

2.8 The Company may, at any time and in its sole discretion, deny you the option to open an Account, limit the Account that you may establish and maintain, or suspend any transaction pending our review of any information submitted by you.

2.9 Upon full registration, you submit an offer to enter into a contractual relationship with the Company based on these Terms. The agreement between you and the Company is concluded with the confirmation of your registration on the Site or App. Upon successful completion of the registration process, the Company will establish your Account.

2.10 You are responsible for safeguarding the passwords you use to access the Service and agree to be fully responsible for activities or transactions that relate to your Account or password. You must notify the Company immediately if you learn of any unauthorized use of your Account or password.

3. Feedback and Suggestions

We welcome your feedback, comments, and suggestions regarding Jimly. By submitting feedback, you grant us the right to use such feedback without any obligation to you. We may use this information to improve our services and enhance user experience.

4. Data Collection and Privacy

We collect and process personal data in accordance with our Privacy Policy. By using Jimly, you consent to the collection, use, and disclosure of your personal data as described in our Privacy Policy. 

5. Account Deletion and Data Retention

You have the right to delete your account at any time. Upon deletion, all associated data will also be removed from our Firebase database. Please note that we may retain certain information as required by law or for legitimate business purposes.

6. Third-Party Services

Jimly may include links to third-party websites or services, including but not limited to AdMob and Firebase. We are not responsible for the content or practices of these third-party services. We recommend reviewing their respective terms and privacy policies.

7. Intellectual Property

All content within Jimly, including text, graphics, logos, and software, is the property of Jimly or its licensors. You may not reproduce, distribute, or create derivative works from any content without our express written permission.

8. Disclaimers and Limitation of Liability

Jimly is provided on an "as is" and "as available" basis. We do not warrant that the application will be uninterrupted, secure, or free from errors. To the fullest extent permitted by law, we disclaim all warranties, express or implied.

In no event shall Jimly or its affiliates be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the application.

9. Risks of Online Communication and Dating

9.1 Engaging in online communication and dating carries significant risks. Many individuals may attempt to commit fraud to gain access to your financial resources. You should communicate with other users with caution and avoid sharing any personal or banking information that may make you vulnerable.

9.2 You acknowledge that the Company is not a licensed marriage broker or dating agency under any applicable legislation. Jimly provides access to a platform where users can communicate independently without matchmaking services provided by the Company. Access to the application is free, though some features may incur charges.

9.3 You must comply with your local laws, and you may not use the Service if access to the application is prohibited in your country of residence or citizenship.

10. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting in the application. Your continued use of Jimly after changes are made constitutes your acceptance of the new Terms.

11. Governing Law
